These Terms and Conditions (“Terms”) constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“User” or “you”), and Nordic Topothea, concerning your access to and use of the S U L E platform, website (https://thesule.com), and any associated applications or services (collectively, the “Service”).

By accessing or using the Service, you agree that you have read, understood, and agree to be bound by all of these Terms. If you do not agree, you are expressly prohibited from using the Service and must discontinue use immediately.

1. Definitions and scope of service

  • S U L E is a live, fully operational software platform owned and operated by Nordic Topothea.
  • The Service functions as a consolidated personal health heads-up display (HUD) designed to aggregate and sync health telemetry parameters, electronic health record (EHR) data, and external wearable metrics into a unified interface.
  • Global access: the Service is intended for global use. You are responsible for ensuring your use complies with all applicable local, national, and international laws.

2. Strict medical and liability disclaimers

  • Not a medical device: S U L E is strictly an informational and organizational software platform. It is not a certified medical device, is not cleared by any regulatory health authority, and must never be used for clinical diagnosis, treatment, prevention, mitigation, or management of any disease or emergency medical condition.
  • No medical advice: any data, metrics, AI-driven documentation assistance, or parameter ranges displayed are provided strictly for informational and reference purposes. They do not constitute medical opinions or advice. Always consult a qualified, licensed healthcare professional for medical decisions.
  • No emergency recourse: the platform, including any configured “tolerance” alerts or notifications, is not a monitored life-safety system. Delivery of notifications depends on third-party networks, internet connectivity, and hardware state. Nordic Topothea assumes no liability for missed alerts, network latency, or data discrepancies.

3. Accounts, registration, and data sovereignty

  • Account creation: to use the Service, you must register using a valid, verifiable email address. You are entirely responsible for maintaining the confidentiality and security of your login credentials.
  • Data control and deletion: you retain complete ownership and data sovereignty over your health history. You may permanently delete your account and entire health record at any time via the platform’s dedicated delete tool or by contacting contact@thesule.com.
  • Account termination: Nordic Topothea reserves the right to suspend, restrict, or terminate any account, without notice, if we detect fraudulent activity, system abuse, or violation of these Terms.

4. Third-party devices, wearables, and plugins

  • Catalog mapping disclaimer: S U L E supports data synchronization with various third-party wearable devices and makers.
  • Presence is not partnership: the inclusion of any brand, product, or maker name in our parameter catalog or interface does not imply an official partnership, commercial affiliation, regulatory clearance, or endorsement by or with those respective brands.
  • Integration limits: we do not guarantee uninterrupted interoperability with third-party hardware, as updates by external device manufacturers may temporarily or permanently disrupt data sync pipelines.

5. Fees, billing, and commercial transition

  • Live service availability: S U L E is an active, live software service. Nordic Topothea reserves the right to offer the Service through tiered pricing structures, including free options and premium paid subscriptions.
  • Subscription opt-in: pricing details for premium features will be clearly stated inside the platform. You will not be charged or converted to a paid tier without your explicit consent and selection of a paid plan.

6. Market demonstration and data validity

  • Reference demonstrations: any screenshots, video loops, charts, or vital sign trends (such as heart rate bands or physiological variations) displayed publicly on the promotional pages of https://thesule.com are simulated reference demonstrations. They do not represent real human medical histories, active patients, or real telemetry data.
  • Live accounts: once logged into a verified dashboard, values will strictly reflect the genuine data uploaded by the user or synced from a paired wearable device.

7. Limitation of liability and indemnification

To the maximum extent permitted by law, Nordic Topothea, its directors, employees, or partners shall not be liable for any direct, indirect, incidental, special, or consequential damages, including but not limited to medical complications, misdiagnoses, data loss, software downtime, or hardware failure resulting from your use or inability to use the Service.

You agree to indemnify and hold harmless Nordic Topothea from any claims, losses, or legal liabilities arising out of your misuse of the platform or violation of these Terms.

8. Governing law and contact

These Terms shall be governed by and construed in accordance with the laws of Denmark/the Nordic region, without regard to its conflict of law principles.
